These terms and conditions of sale are concluded between:

On the one hand, the company Rue des Vents, SRL with a capital of 10,000 euros.

Enterprise No. 0740.576.291 - Petite rue 56 - 7700 Mouscron - Belgium.

And on the other hand, any natural or legal person wishing to make a purchase on the website of ruedesvents.com or ruedesvents.be or ruedesvents.fr.

Hereinafter "the customer" or "the buyer":

Article 1 - Object

These terms and conditions of sale aim to define the contractual relationships between Rue des Vents and the buyer, whether professional or consumer.

The acquisition of a good or a service through this site implies an unreserved acceptance by the buyer of these terms and conditions of sale. These terms and conditions apply to the exclusion of all other conditions, particularly those in force in stores.

They will prevail over all other general or specific conditions not expressly agreed by Rue des Vents.

Rue des Vents reserves the right to modify its terms of sale at any time.

In this case, the applicable conditions will be those in force on the date of the buyer's order.

Article 2 - Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the Rue des Vents site.

These products and services are offered within the limits of available stocks.

Stocks are updated every week. However, it may happen that the number of products ordered is greater than the number of products in stock. In this case, you will be notified by email, and we will indicate the availability date of your product.

The photographs in the catalog are as accurate as possible but cannot ensure a

perfect similarity with the offered product, especially in terms of colors.

Article 3 - Occasions

The products sold in the "Occasions" category have a particular regime.

These items benefit from lower prices than those commonly practiced by Rue des Vents, they have been selected on the following criteria:

Products received in our stocks with:

Damaged packaging.

A defect of an aesthetic nature, normal wear and tear (defect of varnish, scratches, dents, deteriorated coating, etc.).

A breakage noted on a new product.

Products that have been returned by a customer:

For personal convenience.

For an aesthetic defect.

A breakage noted.

In all cases, these materials have been rigorously examined: they have been checked and/or repaired so that their functional qualities are attested.

If visual imperfections persist, they are therefore indicated in the item's sheet, unless specified they do not call into question the proper functioning of the product.

By buying the instruments and materials from the Occasions category you benefit from the legal right of withdrawal of 14 days.

The delivery times for Occasions products can be extended from 48h to 72h.

The downgraded products being unique, they benefit from a specific guarantee, in case of impossibility of repair, an exchange for the same new product is impossible, a credit note or a refund will be made at the customer's request.

Article 4 - Rates

The prices of our products delivered in Belgium and Europe are indicated in Euros all taxes included excluding participation in processing and shipping costs.

The prices of our products delivered outside Europe are indicated in Euros excluding taxes, excluding participation in processing and shipping costs. The payment of the applicable VAT, as well as customs duties, is made by the customer to the local tax and customs authorities.

Rue des Vents reserves the right to modify its prices at any time, it being understood however that the price displayed on the day of the order will be the only one applicable to the buyer.

Any change in the VAT rate may be passed on to the price of products or services.

Article 5 - Availability

The offers of products and prices are valid as long as they are visible on the Rue des Vents site, within the limits of available stocks.

Orders are processed upon receipt of payment and according to product availability. In the event of product unavailability after placing the order, Rue des Vents will inform the buyer by email, SMS or letter indicating the product's availability date. In case of definitive unavailability of the product, the order will be canceled and the buyer will be immediately refunded if his bank account has been debited.

For non-stocked products, offers are valid subject to availability from suppliers. In this context, indications on the availability of products are provided at the time of placing the order. These informations coming directly from Rue des Vents suppliers, errors or modifications can exceptionally exist. In the event of product unavailability after placing the order, Rue des Vents will inform the buyer by email, SMS or letter, as soon as it receives the information from its suppliers. Similarly, it may happen that the number of products ordered is greater than the number of products in stock. In this case, you will be notified by email, SMS or letter and we will indicate the product's availability date.

Article 6 : Orders

The buyer, who wishes to purchase a product or service, must:

  • Fill out the identification form on which he will indicate all the requested contact details, as well as all the information necessary for delivery (including access codes to building doors). The password that allows access to his customer account is strictly personal. During each visit, when he accesses his personal data in his session, or when he places an order, the customer will have been identified beforehand by his username and password, it being specified that this does not serve to make payment;
  • Fill out the online order form by giving all the references of the chosen products or services;
  • Validate the order after checking it;
  • Make the payment under the conditions provided.

The confirmation of the order implies acceptance of these terms of sale, acknowledgment of having perfect knowledge of them, and renunciation of availing oneself of one's own purchasing conditions or other conditions. All the data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will be a signature and acceptance of the operations carried out.

Rue des Vents will communicate by email confirmation of the recorded order. Rue des Vents cannot be held responsible for the consequences of any events beyond its control, particularly in cases of force majeure, which would tend to delay or prevent the online order. Some orders may be subject to additional requests from the customer. In this case, the customer is notified by email or phone of the supporting documents to be sent in order to obtain final validation of his order. Rue des Vents reserves the right to cancel the order in the event of non-receipt of supporting documents or receipt of non-compliant documents.

The customer's order may be canceled by Rue des Vents, for any reason whatsoever, particularly in the event of a lack of information necessary for delivery. The customer will be informed.

Article 7 - Payment Methods

Payment for purchases made on the Rue des Vents website is made at the time of ordering, at the buyer's choice:

By credit card from the CB, VISA, and MASTERCARD networks.

Credit card payments are made through the secure system that uses the SSL (Secure Socket Layer) protocol so that the transmitted information is encrypted by software, and no third party can take note of it during transport on the network.

By Bank Transfer: The buyer bears the transfer fees.

The customer's order will be considered accepted after confirmation of payment and its validation. The merchandise will remain the property of Rue des Vents until the complete settlement of the invoice.

Any payment after the payment date provided during the transaction may result in the billing of late penalties without any prior formal notice being necessary. The rate of these penalties is equal to three times the legal interest rate. Acceptance of the package automatically entails, in the event of late payment, the application, in addition to late penalties, of the administrative costs incurred by the late collection of the invoice, which may amount to 15% with a minimum of 20 euros.

Article 8 - Delivery

8.1. Generalities

The customer undertakes to transmit, when ordering, all the information necessary for delivery to ensure its successful completion. The customer must, in particular, transmit a telephone number at which the carrier can reach him during the day. The customer undertakes, for himself or for the recipient of the order, to take delivery of the goods at the address he indicated when ordering.

Upon delivery, the customer or the recipient of the products must be able to, if requested, provide proof of identity. The customer undertakes, after opening and checking the contents of the package(s) in the presence of the carrier, to sign the delivery receipt presented by the delivery person.

In the event of damage, non-compliant delivery, breakdown upon unpacking, or defective products, refer to the "return management" article. Delivery does not include the commissioning of devices.

8.2. Shipping and Delivery Time

The shipping time is understood excluding transport time and working days. In the case of payment by check, the order will only be processed upon receipt of payment. Consequently, the applicable deadlines in this case are those on the day of receipt of the check and may therefore be modified compared to those mentioned on the day of placing the order.

An additional delay is generally to be expected for shipments to Corsica. In the event of a foreseeable extension of the shipping time, Rue des Vents undertakes to inform the customer as soon as possible and by any means so that he can then choose to maintain or cancel all or part of his order. The delivery time cannot, under any circumstances, result in the payment of damages to the customer or his service providers.

In the event of a shipping delay, an email will be sent to the customer.

In this case, and as long as the product has not been shipped, the customer has the option to request a refund in the form of credit, which will be credited to his customer account within 48 hours. This credit is valid for 1 year from its date of issue. If the customer chooses to be reimbursed, a check or transfer of the product's amount will be sent within 15 days following the issuance of this credit.

8.3. Participation Fees for Preparation and Shipping

Shipping costs are calculated before the customer's final confirmation of the order.

For any order over €1 including tax, Rue des Vents offers free shipping.

8.4. Delivery to Overseas Territories

Orders to be delivered to an Overseas Department or Territory are invoiced excluding VAT. Upon delivery, local tax and customs authorities will require:

the amount of applicable VAT

a sea grant (at the discretion of local authorities)

customs control fees. These costs are borne by the customer.

8.5. Possible Delivery Methods

Delivery by Colissimo expert or Bpost.

Delivery from Monday to Saturday. Packages are delivered to the customer's home within 24/48 hours. The buyer receives an email confirmation from our partner as soon as the package is available. It will remain there for 7 days before being returned to the sender. To collect the order, the buyer must have an ID.

Delivery of bulky products (more than 30 Kg).

In the case of bulky products - especially tubas, the buyer must first check the dimensions of access (door, elevator, stairwell...). Deliveries are made to the threshold of the recipient's address if it is accessible to the delivery vehicle.

The driver is in no way obliged to deliver the goods to a recipient living upstairs.

Standard delivery of small packages:

Delivery from Monday to Saturday

In case of absence, a notice is left in your mailbox, and your package must be picked up at the post office indicated on the notice.

We offer to deliver to your workplace. To do this, simply indicate the name and address of your company as the shipping address.

Article 9 - Return Management

9.1. Packages not distributed by the provider:

In the event of a confirmed declaration of loss of the package by our carrier, depending on the nature of the product, available stocks, and the customer's wishes, we will offer to resend the originally ordered product or an exchange product with equivalent characteristics.

Failure to deliver the customer due to his fault (missing a delivery appointment, non-collection of the package after notice of passage, etc.) results in the loss of participation in shipping costs for him. If the customer does not wish to have the originally ordered product or an exchange product with equivalent characteristics resent, a credit will be credited to his account within 48 hours after receipt of the package by Rue des Vents. This credit is valid for 1 year from its date of issue. If the customer chooses to be reimbursed, a check for the amount of the product will be sent within 15 days following the acceptance of the return.

9.2. Transport Damage:

This case concerns damaged packages, broken packages, missing or deteriorated products. The customer will make characterized reservations on the delivery slip, have the delivery person co-sign, and keep a copy of the document. If the product is damaged, the customer must imperatively refuse the package and note the visible damage on the delivery slip.

These reservations must be very precise. The mention "subject to unpacking" does not constitute a characterized reservation and has NO LEGAL VALUE. It is then essential to describe precisely the state of the packaging and/or the product, and to characterize precisely the damages (for example: Breakage noises, Open package, Damaged packaging, Torn, Dented on the bottom right corner, Scratched product, Dented, on the left side, package refused because opened or damaged during delivery...). The customer must also confirm these reservations to the carrier by email (contact@ruedesvents.com) within 48 working hours following receipt of the item(s), and send a copy of this letter

to: Rue des Vents - Petite rue 56 - 7700 Mouscron - Belgium, clearly recalling the references on the delivery slip.

Note: The verification of the product's condition is considered to have been carried out as soon as the delivery slip has been signed.

By signing the delivery receipt outside of specific reservations, and accepting the products, the customer acknowledges having received the goods in a state that gives him complete satisfaction.

After receipt and acceptance of the package by our services, depending on the nature of the product, available stocks, and the customer's wishes, we will offer to resend the originally ordered product or an exchange product with equivalent characteristics.

In the case where the customer does not wish to have the originally ordered product or an exchange product with equivalent characteristics resent, a credit will be credited to his customer account within 48 hours after receipt of the package by Rue des Vents. This credit is valid for 1 year from its date of issue. If the customer chooses to be reimbursed, a check or transfer of the product's amount will be sent within 15 days following the acceptance of the return.

9.3. Delivery not in compliance with the order in quality or quantity:

In the event of a defect in the use of an instrument (mechanical problem) applicable during the 2 years of guarantees or more of an instrument, the customer must fill out this attached return form to download from our "contact" section.

9.4. Breakdown upon unpacking, Defective product:

The customer must send a return form available and downloadable from the "contact" section.

A confirmation of support will be sent to the customer within 48 to 72 hours for a standard exchange, subject to compliance with return conditions.

The return of products must be made in their ORIGINAL PACKAGING, in perfect condition, accompanied by all accessories and possible instructions, as well as the form provided by customer service, duly completed. Incomplete, damaged, damaged, used, or soiled returned items cannot be exchanged and will be subject to paid repair not covered by the warranty.

Returns from mainland France are made exclusively after agreement with customer service. Return costs will be borne by the customer. The customer has 30 days to return his merchandise.

Any unjustified return (unproven failure, adjustment, failure due to misuse) will be invoiced to the customer: intervention costs (hourly rate) and return of the goods.

9.5. Withdrawal and Right of Return

Return Conditions:

Buyers, non-professional individuals, have a withdrawal period of fourteen days from the delivery of their order to return the product to the seller for exchange or refund without penalty.

All items can be exchanged or refunded within the legal deadlines, excluding items on sale or purchased during a promotional period, which cannot be refunded.

For hygiene reasons, reed boxes, mouthpieces, nozzles, and all related accessories are delivered in sealed packaging. Returns of these products will not be accepted once they have been unsealed.

The date of receipt of the delivered product is authoritative in assessing the fourteen-day period. Return costs are borne by the customer. In the context of an order for several products, the period begins to run from the receipt of the last product delivered.

The customer must fill out the contact form available and downloadable (contact section) and return it to us by email or mail.

The return of products must be made in their ORIGINAL PACKAGING, in perfect condition, accompanied by all accessories and possible instructions, as well as the form provided during the delivery of the product, duly completed. Incomplete, damaged, damaged, used, or soiled returned items cannot be taken back and will be returned at the customer's expense.

Refunds for products will be made within a period equal to or less than 14 days after receipt of proof of shipment

Terms for returning products

Non-professional individual buyers have a 14-day withdrawal period from the delivery of their order to return the product to the seller for exchange or refund without penalty.

All items can be exchanged or refunded within the legal deadlines. For hygiene reasons, boxes of reeds, mouthpieces, beaks, and all related accessories are delivered in sealed packaging. Returns of these products will not be accepted once they have been unsealed.

The date of receipt of the delivered product is proof to appreciate the 14-day period. Return costs are the responsibility of the customer. In the case of an order for several products, the deadline starts running from the receipt of the last delivered product.

The customer must fill out the contact form available and downloadable (contact section) The return of the products must be made in their ORIGINAL PACKAGING, in perfect condition, accompanied by all accessories and possible instructions as well as the sheet provided during the delivery of the product, duly completed. Incomplete, damaged, damaged, used, or soiled items will not be taken back and will be returned at the customer's expense.

Refunds for products will be made within 14 days or less after receipt of proof of shipment by the customer, or failing that, after actual receipt of the package by us. The refund will be made at the choice of Rue des Vents by credit to the customer's bank account or by bank check sent to the customer's billing name and address.


The legal warranty of conformity is defined by articles L 211-4, L 211-5, L 211-7, L 211-8, L 211-11, and L 211-12 of the Consumer Code. The warranty against hidden defects and flaws is defined by articles 1641 to 1649 of the Civil Code. Actions based on the legal warranty of conformity and the warranty against hidden defects and flaws are prescribed by two years from the delivery of the sold goods. In the case of non-conformity or hidden defects, the return costs are the responsibility of the seller.

A manufacturer's warranty is offered for each product (between 1 and 5 years, refer to each product sheet). This manufacturer's warranty does not cover:

• the replacement of consumables (batteries, reeds, ...)

• accessories, cases, and covers

• abnormal or non-compliant use of the products. We invite you to consult the user manual provided with the products carefully in this regard

• damage due to the intervention of a repairer not approved by each brand, manufacturer, or importer

• damages resulting from an external cause to the device (accident, shock, temperature and/or humidity variations ...)
